Terms of Use

These Terms of Use constitute a legally binding agreement between you and 1Host.ing LLC (“Company”, “we”, “us”, or “our”) governing your access to and use of the Sylt.ing website, platform, and services (collectively, the “Site” or “Platform”).

BY LOGGING INTO, ACCESSING, OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE. You represent and warrant that you have the right, authority, and capacity to enter into these Terms. YOU MUST BE AT LEAST 18 YEARS OF AGE to use the Platform. If you do not agree with all the provisions of these Terms, you must not access or use the Site.

These Terms incorporate by reference all additional terms, guidelines, rules, and policies posted on the Platform. These Terms require the use of binding arbitration on an individual basis to resolve disputes and limit the remedies available to you in the event of a dispute.

1. Access to the Site

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial use.

Restrictions

You agree not to:

  • Sell, rent, lease, transfer, assign, distribute, host, or commercially exploit the Platform;
  • Modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Platform;
  • Access the Platform to build a similar or competitive website, service, or marketplace;
  • Copy, reproduce, distribute, republish, download, display, or transmit any portion of the Site except as expressly permitted.

The Company reserves the right to change, suspend, or discontinue the Platform (or any part thereof) at any time with or without notice. You agree that the Company shall not be liable for any such change, suspension, or termination.

2. No Support or Maintenance

You acknowledge and agree that the Company has no obligation to provide you with any support, maintenance, or updates for the Platform.

3. Intellectual Property

Excluding any User Content you provide, all intellectual property rights in the Platform and its content are owned by 1Host.ing LLC or its suppliers. These Terms do not transfer any ownership rights to you.

4. User Content

“User Content” means any AI models, LoRAs, prompts, datasets, scripts, images, videos, text, comments, posts, or other materials you submit to the Platform.

You are solely responsible for your User Content. By submitting User Content, you grant 1Host.ing LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, use, distribute, display, and promote your User Content on the Platform.

You represent and warrant that your User Content does not violate any third-party rights and complies with our Acceptable Use Policy. The Company may remove any User Content at its sole discretion.

5. Acceptable Use Policy

You agree not to use the Platform to upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, harassing, or infringing. You also agree not to engage in spam, hacking attempts, unauthorized data collection, or use of automated bots.

We reserve the right to investigate and take appropriate action, including account termination, for violations of this policy.

6. Feedback

Any feedback you provide to the Company is non-confidential, and you assign all rights in such feedback to us.

7. Indemnification

You agree to indemnify and hold harmless 1Host.ing LLC, its officers, employees, and agents from any claims, losses, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

8. Third-Party Links & Ads

The Platform may contain links to third-party websites and advertisements. We are not responsible for such content, and you access them at your own risk.

9. Refund & Cancellation Policy

All sales made through the Sylt.ing Marketplace are transactions between users (buyer and seller). Refunds, returns, and cancellations are governed by the individual seller’s policies.

  • Digital Products (AI models, LoRAs, prompts, datasets, scripts, courses, etc.): Due to the nature of digital goods, all sales are final and non-refundable once the file has been downloaded or accessed.
  • Services (freelance work, consulting, etc.): Refund requests must be handled directly between buyer and seller.
  • Company Fees: All platform fees, listing fees, and subscription fees paid to 1Host.ing LLC are non-refundable.

Sylt.ing may, at its sole discretion, assist in mediation but is not obligated to provide refunds on behalf of sellers.

10. Chargebacks and Payment Disputes

Users agree not to initiate a chargeback, reversal, or dispute with their payment provider without first attempting to resolve the matter directly with the seller or the Company.

If you initiate a chargeback without prior good-faith effort to resolve the issue, the Company reserves the right to:

  • Immediately suspend or permanently terminate your account;
  • Ban you from using the Platform;
  • Offset any resulting losses against your account balance or future earnings;
  • Pursue legal remedies where appropriate.

Frivolous or unjustified chargebacks may result in permanent loss of access to the Platform.

11. Dispute Resolution Between Users

Disputes between users (including buyer-seller disputes) should first be resolved directly between the parties involved. The Company is not obligated to mediate such disputes but may, at its sole discretion, offer a facilitation channel. You release 1Host.ing LLC from any claims arising from disputes between users.

12. Disclaimers

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall 1Host.ing LLC or its suppliers be liable for any indirect, consequential, or punitive damages. Our total liability to you shall not exceed Fifty U.S. Dollars (USD $50).

14. Term and Termination

We may suspend or terminate your access to the Platform at any time for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately.

15. Dispute Resolution (Arbitration Agreement)

Please read this Arbitration Agreement carefully. It affects your legal rights.

Applicability of Arbitration Agreement. All claims and disputes arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally shall be resolved by binding arbitration on an individual basis.

Notice and Informal Resolution. Before initiating arbitration, you must first send a written Notice of Dispute to the Company. If the dispute is not resolved within thirty (30) days, either party may initiate arbitration.

Arbitration Rules. Arbitration shall be conducted through the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single neutral arbitrator.

Waiver of Jury Trial & Class Actions. You and the Company waive all rights to a jury trial. All disputes must be arbitrated on an individual basis — class actions, consolidated actions, or representative actions are not permitted.

Location. Arbitration hearings shall be held within 100 miles of your residence, unless otherwise agreed.

Authority of Arbitrator. The arbitrator may award any relief available under law on an individual basis. The arbitrator’s decision is final and binding.

Small Claims Court. Either party may bring an individual action in small claims court instead of arbitration.

Governing Law. This Arbitration Agreement is governed by the Federal Arbitration Act.

16. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of laws principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Atlanta, Georgia.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
